New features in version 8.4 include enhanced identification and management of privileged documents.
It is commonly assumed that the duplicates of a given privileged document will always be categorized as privileged. But in fact, in many situations, counsel may determine that some copies of a privileged document are in fact responsive. The distinction may have to do with the identity of individuals sending or receiving a communication, or the existence of attachments associated with one or more of the duplicate copies.
The DWR advanced privilege management identifies existing duplicates, and provides document family groups (with associated attachments and conversation threads) to allow attorneys to examine potentially privileged content in a contextual view. In review, Digital WarRoom provides the ability for review attorneys to select from custom-created privilege phrases that can be edited at the document level and attached at time of privilege determination. In the production phase within Digital WarRoom, the system provides consistency checking at time of production to reduce risk of inadvertent waiver of privilege.
Documents marked privileged, along with annotations, reviewer decision details are automatically included in a system-generated privilege report. The Privilege Log is an exportable spreadsheet including document title, subject, reviewer details, reviewer’s privilege notations, marks, and other key details. Once exported, the privilege log is easily edited. All privileged documents may be saved in a binder for sharing with counsel or client, or for archiving. “Creation and management of a Privilege Log is one of the most time-consuming and painful processes that litigation support teams have to deal with” said Barry O’Melia, who heads up the Digital WarRoom product division. “Our automated privilege log will easily save hundreds of hours of work on the typical e-discovery case, and free up paralegals and litigation support staff to focus on more strategic efforts for their clients.”
Efficient Redaction
Enhancements to the redaction features in Digital WarRoom save time when working with large documents. An ‘inverse redaction’ capability allows the review attorney to select responsive content and automatically redact the remainder of the document. Redaction placement, fonts, phrases and colors are also customizable.
