New features in version 8.4 include enhanced identification and management of privileged documents.

It is commonly assumed that the duplicates of a given privileged document will always be categorized as privileged.  But in fact, in many situations, counsel may determine that some copies of a privileged document are in fact responsive.  The distinction may have to do with the identity of individuals sending or receiving a communication, or the existence of attachments associated with one or more of the duplicate copies.

 

The DWR advanced privilege management identifies existing duplicates, and provides document family groups (with associated attachments and conversation threads) to allow attorneys to examine potentially privileged content in a contextual view.  In review, Digital WarRoom provides the ability for review attorneys to select from custom-created privilege phrases that can be edited at the document level and attached at time of privilege determination.  In the production phase within Digital WarRoom, the system provides consistency checking at time of production to reduce risk of inadvertent waiver of privilege.  

 

Documents marked privileged, along with annotations, reviewer decision details are automatically included in a system-generated privilege report.  The Privilege Log is an exportable spreadsheet including document title, subject, reviewer details, reviewer’s privilege notations, marks, and other key details.  Once exported, the privilege log is easily edited.  All privileged documents may be saved in a binder for sharing with counsel or client, or for archiving.  “Creation and management of a Privilege Log is one of the most time-consuming and painful processes that litigation support teams have to deal with” said Barry O’Melia, who heads up the Digital WarRoom product division.  “Our automated privilege log will easily save hundreds of hours of work on the typical e-discovery case, and free up paralegals and litigation support staff to focus on more strategic efforts for their clients.”

 

Efficient Redaction

Enhancements to the redaction features in Digital WarRoom save time when working with large documents.  An ‘inverse redaction’ capability allows the review attorney to select responsive content and automatically redact the remainder of the document.  Redaction placement, fonts, phrases and colors are also customizable.

Chief Scientist of RenewData to Host Language-Based Analytics Discussion at #LTNY

Time for Firms to Open Up the Doors to Greater Productivity

Social networking is more than just another communications medium.  It has become the primary means of sharing knowledge and information for increasing numbers of individuals and organizations.  Traditionally, businesses and law firms, especially, have been  more concerned with the potential risks of adopting social network models into their workflows than with the profit-impacting benefits of social networking tools on their organizations.  Deploying and adopting a social network based work flow system would enable a law firm to increase productivity and enhance the quality of the work product of its attorneys, and at the same time, increase client satisfaction.  It is a system that complements or otherwise extends the social dynamics of a law firm, encouraging constructive competition among its service professionals and increasing transparency of its workflow to the clients. In the long run, greater client satisfaction will increase law firm revenues, and in our new legal era, that is everything. 

How, then, can these powerful networking tools be leveraged in a large organization such as a law firm with thousands of professionals and clients—securely?  A large law firm, for instance, has all the concomitant characteristics of a social network structure:  groups of social influencers and followers, web of different professional and social associations, and project teams formed for specific client projects.  The sum total of their interactions, i.e., communications and work product, constitute proprietary Big Data of the organization, from which the law firm can leverage and monetize. 

There is an answer:  Closed circuit social networks in which the law firm’s staff and clients are invited to and participate in a social network managed and controlled by the law firm.  

Best of breed social network tools should allow the users to organize themselves in public or private groups.  Each group will have an area for discussion and a virtual library for storing documents.  Public groups would permit anyone in the closed community to join while private groups can only be joined with the group owner’s permission.  Private groups are tantamount to closed-door meetings.  On the other hand, public groups are more free-wheeling, to the extent allowed by the group moderator, and may be used for bond-building purposes or for general interest discussions around topics such as intellectual property law development, cross-border litigation, and securities law. 

These groups will increase the quality of the work product of the lawyers as they will be pressured to demonstrate to their colleagues their breadth and depth of knowledge and expertise of their chosen fields of law.  Healthy competition among the lawyers will benefit the law firm as a whole.  The closed private groups can be used for confidential discussions, information gathering and document collection by client and professional teams for purposes such as possible M&A transactions or litigation materials protected by a court protective order.  Once inside these closed private groups, the invited clients and professionals can freely and confidentially discuss and share documents.  All comments are recorded and ownership of documents is indicated so that everyone is on the same page.

ROCHESTER, N.Y., January 22, 2013 – Demand for Xerox Corporation’s (NYSE: XRX) e-discovery offerings continues to rise as businesses and law firms grapple with the challenges of extracting value from “big data” to meet legal and regulatory compliance objectives. Xerox Litigation Services, the e-discovery division of Xerox, today reported a 100% increase in the number of law firm and corporate legal department client end users over 2011. Data under management – data that Xerox Litigation Services hosts in its SSAE 16 Type II-compliant datacenters and makes accessible to clients via its cloud-based e-discovery platforms – also increased 60% year-over-year.

Xerox Litigation Services’ e-discovery offerings help clients efficiently and cost-effectively address the massive challenges associated with identifying, collecting, analyzing and reviewing information potentially responsive to a matter.
