Information technology security and data preservation are both practical and ethical requirements

Technology has fundamentally transformed the business landscape: highly sensitive and privileged client data is routinely located on computers or networked servers; e-mail has all but replaced the postal service and the paper memorandum; e-filing has become normative and e-discovery has become a regular part of life.

While such fundamental changes to the way business, and the business of law, is practiced has resulted in tremendous gains in efficiency, the challenges presented by this transformation are legion. Information technology security and electronic data preservation are both practical and ethical requirements. Law firms and firm clients have become targets for hackers and other cyber criminals due to the sensitive and valuable information they retain.

At Cylance, protecting you data is our first concern. How we achieve that protection differs fundamentally from the rest of the cybersecurity industry in two crucial ways:

CylancePROTECT is a next generation endpoint protection product built to stop even the most malicious of advanced threats from ever executing in your environment. By leveraging the power of big data, machine learning and genetic algorithms to detect what was previously “undetectable”, CylancePROTECT offers true protection against Advanced Persistent Threat (APT) style attacks.

The Cylance Professional Services team is equipped with cutting- edge proprietary techniques and tools to help your firm – and your clients – manage forward-looking data related risk, as well as to address security breaches that may arise. Our incident response team is available 24/7/365 to assist in the critical first 24 hours, in the unfortunate case a security incident befalls your firm or clients.

At Cylance, we don’t just fix problems; our holistic solutions and guidance protects data while detecting and preventing both current and future intrusions. Rather than waiting until a breach has occurred, we Prevent, Protect and Respond.

From next generation endpoint protection to security assessments, incident response and expert consulting, if you have a problem, Cylance is ideally situated to provide solutions in a discreet, efficient, and professional manner.

Our experts draw on decades of experience in both the public and private sectors and stand ready to assist you or your clients at a moments notice.

By staying ahead of the curve, and taking a proactive stance regarding information security, data protection and preservation, you and your clients will realize substantial savings in cost and attorney time. In short, the best defense is a good offense, and at Cylance, we provide you both, preventing the next attack rather than detecting and responding to the last one.

Consensus CodingSM – a unique, innovative methodology

The Problem with Human Review
We believe in human review. However, even well trained, highly qualified subject matter experts disagree and
their coding decisions may vary greatly.
Human review is also time-consuming, costly and hard to quantify. It’s difficult to effectively measure the quality
of subjective decisions so as to maximize the defensibility of a document review.
Nonetheless, human review is an essential part of litigation. Even processes that augment and extend human
review – such as technology-assisted review (TAR) – rely on human review within the process.
The Solution
iDS confronts these challenges with Consensus CodingSM – a unique, innovative methodology that applies the
feedback mechanisms from information retrieval (like those used to train TAR engines) and pairs them with an
evolving assessment of individual reviewer performance. The result is a measured reliability ranking for each
document tag. Consensus CodingSM assesses the review quality at the document level and at the reviewer level.
It’s not all about technology. Consensus CodingSM is a tailored, comprehensive strategy that combines expert
testimony, experienced consultants and best practices to ensure the successful management of the e-Discovery
document review process for law firms, corporations and document review companies.
The Benefits
QUANTIFY THE ACCURACY OF EVERY DECISION
MEASURE THE QUALITY OF EVERY REVIEWER
! Strengthen defensibility with measurable results.
• Assess document review quality. Achieve a predetermined quality confidence threshold based on
coding decision accuracy. Single documents and the document set are reviewed until they meet or
exceed that threshold.
• Assess individual reviewer quality. Track individual performance by document and within projects
so you can identify the best reviewers by subject matter and document type. Equally important,
you can quickly remove underperforming reviewers.
• Maintain accuracy regardless of scale. Maintain coding decision accuracy regardless of the number
of reviewers or the volume of documents.
! Train TAR engines. Create accurate, measurable seed sets for TAR training and validation.
! Reduce costs. Achieve reliable decisions faster. Work confidently with a wider variety of document
reviewers based on quality ranking rather than tenure, hourly rate or location.
! Built on Relativity®. Works seamlessly with Relativity® and other document review platforms.
! Get back to business. Consensus CodingSM gets you out of e-Discovery and back to business.

LegalTech Plenary Session on TAR and New Book Available TAR for Smart People

At LegalTech NY, Catalyst CEO will moderate the 12:30 p.m. Feb. 3 all-star plenary session, "Taking TAR to the Next Level: Recent Research and the Promise of Continuous Active Learning," featuring panelists Maura R. Grossman and Gordon V. Cormack, two of the e-discovery industry's leading researchers; U.S. Magistrate Judge Andrew J. Peck, author of the first court decision to authorize TAR in e-discovery; and Susan Nielsen Hammond, e-discovery and forensics counsel for Regions Financial Corporation.

Catalyst will also release Tredennick’s new book, TAR for Smart People: How Technology Assisted Review Works and Why it Matters for Legal Professionals. The book serves as a practitioners' guide to TAR and Continuous Active Learning (CAL). Recognizing that TAR is a sophisticated process that draws on science, technology and law, Tredennick set out to write a book that explains the basics of TAR while also exploring advanced issues and applications.

Tredennick is available for expert commentary on TAR and Continous Active Learning (CAL). Tredennick's writings on CAL—which is the protocol used by Catalyst's TAR engine, Insight Predict—have sparked debate among e-discovery industry leaders over several key issues, such as whether subject matter experts are required to train a TAR system and how best to measure recall in e-discovery review.

Cavo eD announces eDiscovery Processing at 57/GB per hour and Production Speeds at 80/pages per second

Cavo eD, the web-based, all-in-one electronic discovery platform, today announced that it has achieved fast processing and production speeds using its distributed web architecture on the Amazon cloud.

Indianapolis, IN (iNewswire) 1-28-2015 - Cavo eD completely processed raw data for a large case at a rate of 57 GB/ hour with all of Cavo eD’s standard steps included and loaded the documents for Review.  Cavo eD’s standard steps include a total processing solution (see details below), not just a simple document ingestion.  Cavo eD then produced these documents at a rate of 80 pages/second for PDFs and 72 pages/second for TIFFs. The Productions included Bates numbering, watermarks and stampings while achieving these speeds.

“These are great speeds,” stressed George Witwer, president of Cavo eD. “We took no short cuts to achieve these numbers. These are speeds our customers should expect to see during a live case.”  Cavo eD calls its processing engine “Processing Plus+” because it is much more than just ingesting documents.
It includes sophisticated data capture that accelerates document review, all in one integrated process.

Steps involved in Cavo eD’s Processing Plus + are: (1) explosion of PSTs and containers, (2) application of a customized deNist list, (3) OCR, (4) multiple customized deduplication methods, (5) indexing of keywords and metadata, (6) customized treatment of embedded objects, (7) removal of boilerplate data, (8) identification of themes that are then measured for dominance and indexed, (9) identification of each document’s summarizing sentences and their addition to the document’s metadata, and (10) document loading for ECA, First Pass Review, predictive coding or other analytics. Similarly, Cavo eD’s Production is full featured, including Bates numbering, custom watermarks, custom stampings and redactions.

Cavo eD is distinguished by its distributed web architecture that can run in the cloud or behind firewalls, proprietary theme search, all-in-one web interface, and business intelligence metrics with automated project management.  With its prior announcement about the software running in the Cloud with its high security standards, Witwer added, “We recognize that everyone in the electronic discovery profession is working hard to keep costs down.”  Today’s processing and production speed announcement is the latest highlight in the product’s history of technological advances and cost savings strategy.

BigHand Announces the Launch of BigHand Now

BigHand, the leading provider of voice productivity and document formatting software, is previewing at LTNY 2015 an enhanced platform that enables law firms to streamline all of their task delegation processes into one easy-to-use solution. This enhanced solution will serve to further reduce inefficiencies and increase accountability between attorneys and support staff via a robust workflow methodology similar to the one incorporated in BigHand’s popular voice productivity software.

In today’s legal market, firms are striving for continuous improvement in efficiency, productivity, and customer service. BigHand is known for their voice productivity software that enables attorneys and their administrative teams to streamline document creation via a comprehensive workflow tool that is integrated within the digital dictation software.

BigHand Now extends the concept of the existing BigHand workflow tool to capture more work input methods - such as email, working documents and manual forms - in addition to dictations, within the BigHand workflow. The workflow provides attorneys with a simple, highly customizable interface to assign tasks to their administrative staff, enabling them to concentrate on higher value, fee earning tasks instead of work administration.

@Legal Announces Data Collection from Cloud Sources

@Legal Discovery, LLC, a full-service eDiscovery technology provider, announced the release of the latest version of CasePoint, which includes functionality for direct collection of cloud-based data from sources such as Gmail™ and Microsoft Office 365™ mail. In addition, the new version improves speed and includes enhanced analytics and greater support for tablets and mobile devices.

“With so many organizations using Gmail and other Web-based platforms for email and document sharing, it became increasingly important for us to help our clients collect data from these locations,” said Haresh Bhungalia, chief executive officer of @Legal Discovery. “This new feature allows CasePoint to move even further to the left within the Electronic Discovery Reference Model and will greatly simplify the collection process for our clients.”

With CasePoint, the collection process is fully automated and requires no secure personal information. In addition to Gmail and Microsoft Office 365 mail, CasePoint can also collect data from other common business tools, such as Google Drive, Dropbox and Microsoft OneDrive.

Other advances include 30 to 50 percent faster document open times, the addition of dynamic analytics, and an updated interface that improves experiences on mobile devices and tablets. Iris Data Services at LegalTech: Companies Fleeing from Transactional eDiscovery Model in Droves

Iris Data Services to Exhibit at LegalTech 2015

Law Firms and Corporations Fleeing from Transactional eDiscovery Model in Droves

Kansas City, January 27, 2015 – Iris Data Services, the global leader in eDiscovery managed services, will be at LegalTech 2015 in New York City. Iris has exhibited at LegalTech for eight years in a row and will be located at booth number 411 this year.

Iris comes into LegalTech having established itself as the torchbearer for eDiscovery Managed Services. Iris’ complete focus on the eDiscovery managed services (EMS) model is why they now have over 30 managed services clients across a wide spectrum of law firms and corporations.

“LegalTech is a rare moment in our industry when almost everyone is at the same place at the same time,” said Major Baisden, president of Iris Data Services. “It’s a great opportunity to catch up with our current clients and talk with future clients about their eDiscovery needs.”

“LegalTech is the super bowl of our industry,” said Damon Goduto, co-founder and senior vice president of sales at Iris. “Our agenda will be twofold: do a lot of business and have a lot of fun.”

Iris’ managed services model is turning the eDiscovery market on its head. For law firms and corporations, it’s finally giving them a complete solution to their eDiscovery problems. For eDiscovery hosting vendors, it’s destroying the huge margins they have historically enjoyed on transactional discovery. Iris is executing its goal to be the best service provider its clients have ever had. Ever.

LegalTech attendees can set up appointments to learn more about Iris’ products and services by sending an email to sales@irisds.com.

According to Roe Frazer, Cicayda’s CEO: “Our goal is to enhance the work life of the eDiscovery professional, to give them even a little happiness in how they work - the true goal of modern technology.”  Frazer adds: “Until the debut of Reprise, the legal technology market suffered from abject stagnation in terms of a contemporary user interface, search and response speed, and modern text analytics. Why should searches, regardless of the data size or complexity of syntax, take so long to execute? We solved that problem and our search is lightning fast - results are returned in milliseconds. Our robust My Cicayda platform includes an intuitive review tool, natural language processing and latent semantic analytics, early case assessment, data reduction advantages, and even a legal hold application.”

eDepoze introduces Witness Prep 2.0!

An unprepared witness can inflict serious damage on your case.
Experienced lawyers therefore put a lot of effort into getting a client ready for an
important deposition, usually through one or more face-to-face witness prep sessions.
Because preparing the witness often involves reviewing relevant case documents,
lawyers can spend just as much time and effort getting ready for a witness prep
session by printing and copying documents days or weeks in advance, creating
individual binders, then lugging them across town or shipping them across the
country for their in-person meetings.

With the new Witness Prep 2.0 software from
eDepoze, you can kill the paper and
streamline the deposition preparation process
as never before:

Welcome to Deposition 2.0!

Still hassling with mounds of paper exhibits? No longer do you need to print
and copy documents days or weeks in advance, lug boxes of paper to the

Research into what TAR methods work better causes stir in e-discovery

Research into what TAR methods work better causes stir in e-discovery

Two of the leading experts on e-discovery, Maura R. Grossman and  Gordon V. Cormack, presented a 2014 peer-reviewed study on continuous active learning to the annual conference of the Special Interest Group on Information Retrieval, a part of the Association for Computing Machinery (ACM), “Evaluation of Machine-Learning Protocols for Technology-Assisted Review in Electronic Discovery.”

In the study, they compared three TAR protocols, testing them across eight different cases. Two of the three protocols, Simple Passive Learning (SPL) and Simple Active Learning (SAL), are typically associated with early approaches to predictive coding, which we call TAR 1.0. The third, continuous active learning (CAL), is a central part of a newer approach to predictive coding, which we call TAR 2.0.

Based on their testing, Grossman and Cormack concluded that CAL demonstrated superior performance over SPL and SAL, while avoiding certain other problems associated with these traditional TAR 1.0 protocols. Specifically, in each of the eight case studies, CAL reached higher levels of recall (finding relevant documents) more quickly and with less effort that the TAR 1.0 protocols. Not surprisingly, their research caused quite a stir in the TAR community.

Former FBI Computer Scientist Creates Unique Tool for Litigators — Timestream

Former FBI Computer Scientist Creates Unique Tool for Litigators — Timestream

After 9/11, Teddy Lindsey decided to leave the private sector to join the FBI as a Computer Scientist, where he was trained as an investigator and deployed in the field. During his career in the Bureau, Teddy worked on a wide range of cases and operations including computer intrusions, drug trafficking, international intelligence, and counterterrorism operations. He distinguished himself and was recognized with a number of commendations, including the FBI Director's Award for Excellence and the DEA Administrator's Award. His last investigation to go to trial before he left the FBI resulted in a conviction on all counts and the longest sentence in U.S. history for a hacking (18 USC § 1030) case.

During Teddy's tenure with the FBI, he became increasingly frustrated with the cumbersome and antiquated case management and presentation protocols he was forced to navigate to do his job. Like many attorneys, he frequently found himself swamped with trivial, low-tech tasks that took valuable time away from case analysis. In addition, there were no tools available that organized and presented his data in the storyline fashion best suited to litigation. He knew there had to be a better way.

Two years after leaving the Bureau, Teddy set out to create that better way. As VP of Research and Development at Ntrepid Corporation, he had the engineers and resources to create the solution he had envisioned. Thus, Timestream was born.

Timestream is an intuitive software suite that integrates case management, timeline, and presentation tools, allowing litigators to organize and visualize case events chronologically. It is packed with powerful features that help to simplify a litigator's workflow.

Timestream features:

  • Drag-and-drop interface
  • Fully indexed fields and attachments for easy keyword searches
  • Customized tagging for easy filtering
  • Portability — all of your documents stored conveniently right in your case file
  • Beautiful HTML5 presentations (no knowledge of HTML5 necessary)
  • Detailed reports
  • Compatibility with both Mac and PC
  • AES case encryption
  • Cloud or network collaboration
  • Digital fingerprinting to verify authenticity of files and chain of custody
  • Craft a scene by scene story within your timeline, complete with captions

Since Timestream's launch in the legal market, civil and criminal litigators alike in law firms of all sizes have adopted Teddy's vision of crafting more compelling stories.

White paper: How Technology Can Increase Profits for Busy Solos

As solos ramp up their billable hours, a one-laptop solution can still work. However, busier solos have additional needs. Time becomes precious when solo firms bill more than 1,000 hours a year. Active solo attorneys have to take advantage of technology to increase efficiency and optimize their time.

Step One: Save Time with Document Generation

A lot of time can be lost in repetitive document generation. If attorneys take advantage of technology, that time can be put to better use.

Anymore, most attorneys aren’t writing each new contract (or other frequently used document) from scratch. Many lawyers attempt to save document creation time by using templates within Microsoft Word, as well as taking advantage of Word features, such as Quick Parts, which allows users to store and insert commonly used text blocks. That can work up to a point.

Document generation application options, such as market leaders HotDocs and ProDoc, are a more robust solution. HotDocs allows attorneys to automate documents they use repeatedly, regardless of complexity. By inserting what they call “business logic” into templates, users can customize documents in a wide variety of ways. ProDoc is a document assembly program that offers document generation packs for specific practice areas, such as family law and administrative law. It provides national systems, as well as those specific to California, Florida, and Texas.
Joe Kelly, CEO for Legal Workspace, says that the use of automated document generators is especially prevalent in real estate and personal injury practices. “In some cases, it’s possible for nearly all documents to be totally automated,” he says. That’s a lot of saved time.

White paper: Legal Software 101

Whether you’re getting ready to hang your own shingle or managing an established law firm, implementing a suite of legal software can seem like a daunting task. You might have been intimidated by the cost, the time to put the new procedures and tools in place and possibly the change from familiar processes. However, even with those hurdles, it pays (literally – it saves money) to improve your practice by adopting technologies that work best for you and your firm.

The four categories of applications commonly used by law firms include:

  • Practice Management Software
  • Document Management Software
  • Time and Billing Software
  • Legal Document Generation Automation Software

White paper: Eliminate Small Firm Growing Pains with Technology

Eliminate Small Firm Growing Pains with Technology

Successful solos often find that they need to add staff to keep up with increased business. Whether the first addition is an administrative assistant, a paralegal, or another lawyer, a growing firm can expect many process changes to happen right away.

These changes can involve some growing pains, but selecting and utilizing the right technology can smooth the way. And, before you know it, a successful solo can transform into a successful small firm, with two to five people collaborating on documents, sharing calendars, and benefiting from a streamlined billing process.

Infographic - How to Simplify Your IT Budget

The New Year is all about changing old ways and starting fresh. Some of the first items to reevaluate are your law firm’s IT operations and budget.

For instance:

  • What did you spend on IT support in 2014?
  • Will you need to replace hardware to keep things running smoothly?
  • What software are you going to be required to upgrade?
  • Have you considered moving your law firm to the cloud?

With so many questions to consider, your IT challenges can be overwhelming.

That’s why Legal Workspace has put together this infographic to show how cloud services for law firms stack up against a traditional on-site IT solution.
