Masters Series for Legal Professionals Announces Chicago Keynote

LegalTech West Coast 2011: Wedsnesday's Plenary Session Recap

Wednesday's plenary session, presented by two United States magistrate judges from the Central District of California, highlighted the importance of using experts and educating judges when cases involve e-discovery. The Honorable Suzanne Segal and Honorable Jay Gandhi touched on the topics of preservation, keyword searches, privilege logs and requesting documents in their native format.


 

Judge Gandhi stressed the importance of using e-discovery experts, saying the bench thinks that e-discovery consultants get pulled in too late, after the data has already been consolidated. He said that as soon as the complaint gets filed, an e-discovery consultant should be pulled in, and that this matters in discovery disputes in court.

 

Judge Segal expressed the need for attorneys and their experts to help judges better understand their case. Judge Segal explained that it is difficult for her to decide on keyword lists because she doesn't necessarily understand the nuances of each case. With respect to a burdensomeness objection, Judge Segal suggested that parties compare their volume of data to something else judges may understand, like "This is more data than is contained in the Library of Congress." LegalTech West Coast Plenary Session

The Corporate Perspective: Why the Legal Industry Needs to Embrace Technology

 

The panel, moderated Monica Bay of ALM, included Tim Hart of McKesson Corporation and Brian Renker from Dell. The backdrop of the discussion was the fact that records management and e-discovery strategies are largely driving technology decisions in both law firms and corporations. Of course regulations and compliance are important factors, along with the continual increase in the amount of data both created and retained as the cost to store data continues to decrease. Creating, implementing, and maintaining solid records retention policies is becoming a more and more important function to effectively manage all of this data. The panel discussed the newest IT mantra – ‘alignment with the business’ – and the critical recognition that while technology can be a great thing, without quality people and processes to effectively manage it, technology can also be a terrible waste of money. “Technology is only as good as the people running it”. The panel also discussed what they called “disruptive technologies” including mobile devices and social media, and the importance of corporations not only allowing but embracing the use of these collaborative tools to enhance productivity.

LegalTech West Coast is off to a Jump Start with Keynote on Social Media

The keynote session held today at LegalTech West Coast was entitled "Social Media and the Law" and was presented by David Pashman, legal team leader of Meetup.com. The session was well-attended ... we guessed about 200 - 250 attendees with standing room only. Judging by the number of attendees and their engagement with the session, the topic is a hot one that many companies are dealing with -- whether they are involved in social media or not. Pashman touched on defamation and the safe harbors that Section 230 of the Communications Decency Act offers to social media providers, and presented real world examples of cases and situations within his own company. He also discussed safe harbors for copyright infringement that the Digital Millenium Copyright Act offers. He also told the audience that trademark usage for social media companies is established within their own internal policies, and that these policies become de facto legal standards. He ran out of time, but not before briefly touching on privacy laws and data security. He told us that Facebook's privacy policy is longer than the U.S. Constitution! His talk ended before he could cover all of his material -- if the schedule had allowed for him to continue his discussion, attendees would have stayed to listen. They were VERY engaged in this session.

Catalyst Search Scientist to Present Paper on Choice in Search

Everyone at some point ponders the path not taken. We can only wonder what might have been. But what if we could know where each path might take us before we had to choose? That, with some poetic license, is the premise of a Catalyst position paper that proposes a new way of selecting the best approach to search from among several alternatives.

Rather than evaluate a search technique based solely on its own metrics, the paper suggests, more optimal results could be achieved by enumerating and storing the consequences of actions at key points in system usage. Once more information is obtained through continued system usage, the relative merits of choices not taken can be made clearer. This should allow information seekers to make better choices in the future.

Catalyst search scientist Jeremy Pickens, a leading researcher on search and analytics and one of the paper’s authors, will present the paper June 6 at the ICAIL 2011 Workshop on Setting Standards for Searching Electronically Stored Information in Discovery Proceedings (DESI IV). In addition, Pickens has been asked to co-lead one of the breakout sessions at the workshop, part of the University of Pittsburg’s International Conference on Artificial Intelligence and the Law.

Pickens jointly authored the paper, Process Evaluation in eDiscovery as Awareness of Alternatives, together with Bruce Kiefer, Catalyst’s director of research and development, and John Tredennick, Catalyst’s founder and CEO.

“The user of an eDiscovery platform needs to know not only how well an information seeking process is running, but how well the alternatives to that process could have run,” the paper states in its introduction. “Our view in this position paper is that one of the more important ways to understand quality is not in terms of absolute metrics on the algorithm, but in terms of an understanding of the effectiveness of the alternative choices a user could have made while interacting with the system.”

Fortune Profiles Catalyst’s CEO

A companion piece published today in Fortune, Meet the Accidental Entrepreneurs, profiles Catalyst’s founder and CEO, John Tredennick. The piece describes how Tredennick, while a litigation partner at the Denver law firm Holland & Hart in the 1990s, became aware of the need for a system to handle the rapidly growing volume of documents involved in litigation.

“I used to be able to go through the case documents on the couch while watching the Broncos,” he told Fortune. “Then, all of a sudden, those documents are in filing cabinets, then war rooms, then document warehouses.”

Still at his former firm, he developed a computer system that would allow employees to share files digitally between offices. After a particularly complex 1998 case involving more than 300 users proved the system’s success, the seeds were sown for what later become Catalyst.
