Video depositions can be problematic, unnecessarily cumbersome and all too often prohibitively expensive. That’s why StoryCloud has introduced an entirely new video deposition platform that is more reliable, secure, remarkably easy to use and inexpensive. 

In the past, a single videographer records a deposition using a traditional video camera and four separate microphones.  The session is often interrupted and halted every two hours to allow for the time limits of recording MPEG1 files on a DVD.  After the deposition, the video content is usually made available to participants days or weeks later by mailing a USB thumb drive, or DVD.  In the event the videographer makes a mistake, improperly framing, focusing, or capturing audio there are no alternatives. The videographer is a single point of failure.

 StoryCloud has a better more secure and reliable way.  First, we record the session with a videographer present using a state of the art iPod, or similar Apple device.  The content, which can be continuously recorded for more than 32 hours, is stored immediately on the Apple device at a rate of 1 gigabyte per hour.  The content is in a native high definition MPEG4 format.  Next, unless unusual circumstances dictate otherwise, we use a single high performance microphone to capture the audio for all participants. Modern audio technology is capable of producing extremely high quality sound in medium sized conference rooms with many participants. 

But a single person behind the camera can still make a mistake, and that’s where StoryCloud’s 30 years of experience in building highly available fault tolerant telecommunications equipment for Cisco, Lucent, Ericsson, Alcatel, as well as its intellectual patent portfolio of three recently issued patents and nine more pending, come in to play.

 While the video and audio are being recorded on the local Apple device during the deposition, StoryCloud connects the system on a Wi-Fi network to the cloud.  Sending small amounts of data (less than one half a megabit per second), the software double checks the videographer using powerful and proprietary algorithms to insure that the content is in focus, properly lit, framed correctly and that the audio can be clearly heard. This means that if the videographer blinks, or happens to fall asleep, we catch it. Simply, this advanced technology enhances the performance of people; making the product vastly more reliable. 

Moreover, depending upon the available bandwidth, the video can be streamed to the cloud during the deposition, or immediately thereafter. At all times during the process the content is safely stored on the local camera, and secure and encrypted when streamed to the cloud. In all cases, it is made available within 24 hours after the deposition.  Downloadable file formats include MPEG1 and MPEG4, as well as, audio WAV and MP3 files.

Most importantly, StoryCloud makes this vastly more reliable and easier to use platform available at an all day, 8-hour rate of $400.00, which is a fraction of the price most attorneys currently pay for an all day video deposition.

Today's Ethics+ Technology - The Intersection of the Two is Difficult Under the Current System

It’s not news that we are living in a totally digitized world. What is not clear is whether the ethical standards that currently exist are complete enough to guide attorneys through the current climate. Lawyers have been bound by some fundamental ethical requirements since the beginning of the profession, but technology, and particularly the eDiscovery process, has resulted in the creation of an uncoordinated series of Federal and State rules, with additional ABA Model Rules of Professional Conduct and even individual State Ethics rules along with current opinions from a variety of Courts. It is difficult for lawyers to keep current given this wide disparity. How should lawyers be prepared to respond to best represent their clients and follow the ethical requirements of their profession? Is the root of the problem the technology or the law?

Document production challenges for litigators has increased dramatically as increasing amounts of information are stored exclusively in digital media, in various formats and locations. The rules that govern the information superhighway are constantly in flux, resulting in a lag in the passage of FRCP and Model Rules of Professional Conduct that dictate what lawyers are responsible for. How should lawyers be prepared to respond to best represent their clients and follow the ethical requirements of their profession?

Digital information is no longer an occasional player in the discovery process; it has become the controlling factor in what has become known as eDiscovery. Texas Law Firm Reduced IT Spend by 50 Percent with Legal Workspace 

Berry Odom LLP is a commercial litigation firm in Fort Worth stacked with Big Law experience. Their passion for litigation inspired its partners to start their own firm. However, they quickly realized how time consuming and expensive managing IT can be. Partner Lane Odom, responsible for the firm’s IT infrastructure and security needs, searched for a solution. Now, with Legal Workspace, Odom spends more time practicing law and less time and money dealing with IT. 

The Story

Lane Odom and Steven J. Berry founded Berry Odom in 2004. Both lawyers had extensive experience on the Big Law side. “My partner and I both worked at large law firms for 15 years before starting Berry Odom in 2004,” Odom says. “Needless to say, the small firm IT environment requires a little more attention than what we were used to at the the big firm.”  

As the managing and administrative partner, Odom tackles responsibilities such as IT in addition to handling his regular litigation law practice that includes contract and partnership cases. “My level of IT expertise is rudimentary,” Odom says. “I know enough to pick up the phone and ask for help.”  

When the firm was founded in 2004, Odom oversaw the firm’s on-site IT setup and operations. They had an in-house server environment and hosted their website on a network maintained by a vendor. The upkeep for the server and updates was expensive.

“We paid a vendor a monthly monitoring fee plus extra to answer questions and come to the office. On top of that, we had to purchase expensive hardware and servers,” comments Odom.  “Overall, that IT infrastructure was expensive to maintain and it took a while every time we wanted to add a user or update software. If you’re not an IT expert, then half the time you don’t know what you’re doing so you have to call – and pay for – the vendor. IT was not the task I wanted to spend my time on.”

The Legal Workspace Advantage

In 2014, the law firm decided to explore an alternative way to approach IT – through the cloud.

“In 2004, the cloud wasn’t an option,” notes Odom. “But by 2014, I began to learn more about the cloud and quickly understood that it offered numerous benefits over on-site IT.” Specifically, he explored Legal Workspace, a service that hosts all software applications needed by law firms in the cloud. “I realized I wouldn’t have to handle all of those IT negatives. With Legal Workspace, the firm could get rid of its server and its expenses and stop having outside vendors monitoring it. All the IT headaches, problems and excessive costs would end with Legal Workspace. We could just plug in and go,” shares Odom. 

The idea of a cloud-based environment and its stable and all-inclusive monthly fee immediately appealed to Odom, but as a risk-adverse professional he did have some concerns. “We’re lawyers,” he explains. “We have to think about privacy and data security. Is an environment secure if I’m not maintaining the server? Where is my data hosted? What is that environment and how is it secured?

Search results also populate a timeline that displays historical occurrences of responsive terms.

The experience is now comparable to how one would buy merchandise from an online retailer, as a buyer would browse categories, use filters and send the desired products to the shopping cart.  In this workflow, users will browse data fields as categories and then promote potentially responsive documents to review. Visual searching and filtering are additional enhancements, while traditional methods of working through these procedures are still available.
